By accessing our website, contacting us for an estimate, or signing a service agreement with us, you confirm that you have read, understood, and agree to be bound by these Terms. We reserve the right to update these Terms at any time. Changes take effect when posted on this page with an updated effective date. Continued use of our website or services after changes are posted constitutes your acceptance of the updated Terms.
Weslaco Deck and Fence is a deck builder and fence contractor serving residential and commercial customers in the Rio Grande Valley, Texas. Our services include, but are not limited to, custom deck design and construction, composite and wood deck installation, deck repair and replacement, deck staining and sealing, fence installation, pergola installation, patio covers, screened-in porches, and related outdoor construction services.
All services are subject to a written agreement or signed estimate between the customer and the Company. We reserve the right to decline any project at our discretion.
All estimates provided by Weslaco Deck and Fence are based on information available at the time of the on-site visit or customer consultation. Estimates are not binding contracts. A written, signed service agreement or proposal is required before any work begins.
Prices may change if the scope of work changes, if unforeseen site conditions are discovered (such as buried utilities, structural issues, or unstable soil), or if material costs change between the time of estimate and the start of work. Any changes to the original scope or price will be communicated to you in writing before additional work proceeds.
Free estimates are provided as a courtesy. Submitting an estimate request does not create an obligation on either party.
Project start dates are scheduled based on mutual availability and are subject to change due to weather, permitting timelines, material availability, or other factors outside our control. We will communicate any schedule changes to you as soon as reasonably possible.
If you need to cancel or reschedule, please notify us as soon as possible. Cancellations made after a signed agreement is in place and materials have been ordered may result in restocking fees or forfeiture of any deposit paid, as outlined in your service agreement.
We reserve the right to suspend or terminate a project if site conditions make it unsafe to continue or if payment obligations are not met according to the agreed schedule.
Payment terms are specified in your signed service agreement. In general, we require a deposit before work begins, with the remaining balance due upon completion of the project or at milestones as outlined in the agreement.
Accepted payment methods will be listed in your service agreement. Payment is due within the timeframe stated in the agreement. Late payments may be subject to interest charges or collection fees as permitted by Texas law.
If payment is not received as agreed, we reserve the right to suspend work, place a mechanic's lien on the property as allowed under Texas law, or pursue collection through legal means.
When required by local ordinance, Weslaco Deck and Fence will apply for and obtain the necessary building permits before beginning work. Permit fees may be included in or added to the project estimate. The customer is responsible for ensuring that any homeowners association (HOA) approvals required for the project are obtained before work begins. We will not be held liable for delays or additional costs caused by a customer's failure to obtain required HOA approval.
We stand behind our work. Specific warranty terms are included in your signed service agreement. In general, we warrant that our workmanship will be free from defects for a period stated in the agreement.
Warranties on materials (composite decking, hardware, fasteners, etc.) are governed by the respective manufacturer warranties, which we will pass through to you where applicable.
Warranty claims related to workmanship must be reported to us in writing within the warranty period. Damage caused by misuse, neglect, modifications made by others, extreme weather events, or normal wear and tear is excluded from our workmanship warranty.
To the fullest extent permitted by Texas law, Weslaco Deck and Fence shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the services we provide or your use of our website.
Our total liability for any claim related to a project shall not exceed the total amount paid by you for that specific project. Nothing in these Terms limits our liability for personal injury or property damage caused by our own negligence.
The information on our website is provided for general informational purposes only. We make no warranties, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of any content on this website. Information about pricing, timelines, or processes is general in nature and does not constitute a binding offer or guarantee.
We prefer to resolve any disputes directly and informally. If you have a concern, please contact us first and give us a reasonable opportunity to address it before pursuing other remedies.
If a dispute cannot be resolved informally, the parties agree to attempt resolution through non-binding mediation before initiating any legal proceedings. If mediation is unsuccessful, disputes shall be resolved in the courts of Texas, and both parties consent to jurisdiction in Hidalgo County, Texas.
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal action arising out of these Terms or our services shall be brought exclusively in the state or federal courts located in Hidalgo County, Texas.
We may revise these Terms at any time by updating this page. Changes take effect when posted. It is your responsibility to review these Terms periodically. Your continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms.
